(organisational contact: dataretention@patrick-breyer.de (Friedemann)) ## Data retention plans in the EU and its Member States By the End of 2021 new documents appeared in public that show how the Commission of the European Union together with various EU member states push for new general data retention obligations [1]. From an digital fundamental rights perspective this is not acceptable. Because sensitive communication and activity data from millions of law-abiding citizens would be retained for no specific purpose. Democratic societies and liberal constitutional states must not enforce blanket mass surveillance. The European Court of Justice (ECJ) has repeatedly emphasized this and declared general data retention to be lawful only in limited exceptions. The default must be: no general data retention. Nevertheless, from documents and the political debate the impression arises, that the Commission of the European Union and some governments of the Member States are trying to run over the rulings of the ECJ and fundamental rights. The quest towards a “cleaner” internet continues – with “censorship machines” included in the EU Copyright Directive, upload filters proposed in the Terrorist Content Regulation, and numerous other initiatives to push dominant platforms to police online content. This talk will present the next big battles for free speech online at the European level.

The next important battle for our rights and freedoms in the digital sphere is looming on the horizon. Policymakers wage war against “harmful” speech online, relying on the centralisation of the web around few platforms that function as “walled gardens”. Heated debates on upload filters recently took place around the copyright reform and the fight against online terrorist propaganda. The next challenge for our freedom of expression online is a planned update to rules that deal with illegal and “harmful” content: E-Commerce Directive. E-Commerce was adopted two decades ago, but the way the internet looks like has drastically changed since. The amount of user-uploaded content has exploded, and few dominant platforms have an increasing impact on people’s rights and freedoms. How does the current online landscape look like? What are the policy options the EU is facing in terms of platform regulation? How can we achieve human rights-compliant content moderation rules?

New European Parliament (EP), new European Commission(EC), possibly Brexit. Nevertheless, the same digital rights we're fighting for. In this talk we will give you an update on what the results of the European Parliament look like, what characterises the new EU Commission and how likely it is that Brexit happens in November 2019. More, we'll update you on the topics we have our eyes on in the EU institutions: the future of content moderation and platform liability in Europe, confidentiality of our communications (ePrivacy), access to data cross-borders by law enforcement, net neutrality, data retention reloaded, algorithms (including upload filters), AI regulation.Finally, we unite the 2 parts: what do the new developments in the EP, EC and Brexity mean for our digital rights fight? How will our rights and freedoms online be impacted by the new environment? Are there new ways and avenues to mobilise and influence policy-making across Europe? There's only one way to find out.
